Said delegation will be effectuated by means of a regulatory proceeding of the body holding jurisdiction when the respective decentralized autonomous government holds the technical and autonomic capacity to directly manage a public service, or in the event of a public calamity or natural disaster. The lack of technical or economic capacity to directly manage a public service must be duly justified by the executive authority before the respective local legislative body and citizenry under the Conditions established in the Constitution, the Law, and in accordance with the regulations of the public administration or Central Government body holding jurisdiction and legal authority in regards of the matter in question.

The corresponding selection must be made by means of public bidding, with the exception of the delegation of jurisdiction as regards to the irrigation, drinking water, and sewage to community organizations.
