    Federal criminal cases typically require a unanimous jury decision. In some cases, though, a less-than-unanimous decision suffices. Civil cases typically require some type of majority decision. There are many reasons for hung juries. Disagreement is often due to varying opinions on presented evidence, different impressions of involved parties plaintiff, defendant, witnesses and attorneys , and varying personal perspectives and beliefs. Members of a jury are individuals who process information in unique ways. Just like a group of friends sometimes has difficulty agreeing, so does a jury.

    Once a jury indicates its inability to reach a required consensus, what happens? Will a judge force the jury to reach a conclusion? Are jurors destined to remain locked in the deliberation room until all parties agree? Hung juries are considered undesirable by many.

    The lack of an answer is often frustrating, not to mention time-consuming and costly. As a result, in some cases a judge might ask the jury to try a bit longer. The term 'Allen charge' refers to instructions provided to a jury when, after initial deliberations, it cannot come to an agreement; in essence, the judge asks jurors to try again.

    In other cases, the judge will immediately declare a mistrial and, when a judge does so, the trial ends and no judgment is rendered. Whether or not a judge instructs a jury to deliberate further, when all deliberations are complete and a jury cannot reach a required agreement despite its best efforts, a hung jury results and the presiding judge declares a mistrial.

    In civil cases, a judge can direct that the case be tried again at some later point in time. In criminal cases, the prosecutor has discretion to decide whether or not to pursue a new trial. A deadlocked or hung jury is one that's unable to reach a required consensus in connection with the legal questions its been asked to decide, even after sufficient opportunities to review all presented evidence in a case. When a mistrial is declared, there is a possibility that a case civil or criminal will be retried.

    A new jury might be able to reach a consensus, even when an initial jury could not.
